1. Scope

The following General Terms and Conditions (GTC) apply exclusively to the business relationship between König Ascona SA (König Sound and Vision) and the customer in the version valid at the time of the order. König Sound and Vision does not recognize deviating conditions of the customer and hereby expressly contradicts them, unless König Sound and Vision had expressly agreed to their validity in writing.

Images of products in advertising, brochures, online shop, etc. are for illustration purposes and are non-binding.

Unless otherwise stated, the items offered in the online shop are in mint condition and any software updates have been carried out and the product subsequently checked. The packaging can therefore already be open.

3rd order

Your order constitutes an offer to König Sound and Vision to enter into a purchase agreement. When you place an order with König Sound and Vision, we will send you an email acknowledging receipt of your order and listing its details (Order Confirmation). This order confirmation does not constitute acceptance of your offer, but is only intended to inform you that we have received your order. A sales contract is only concluded when we send the ordered product to you and confirm the dispatch to you with a second e-mail (dispatch confirmation). No sales contract is concluded for products from one and the same order that are not listed in the shipping confirmation.

4. Prices

All sales prices published in the online shop are final prices that include all taxes (esp. VAT), any early recycling fees (ARF), costs for packaging/s, delivery costs and all other possible taxes, fees or costs. König Sound and Vision reserves the right to change the prices of the products and services offered at any time. The price in the online shop at the time of the order is decisive for the conclusion of the purchase contract.

All prices quoted are in Swiss francs including the statutory value-added tax plus shipping costs. The price of the goods at the time of receipt of the order by König Sound and Vision, which is printed on the invoice, is decisive for the invoice amount. König Sound and Vision reserves the right to price errors and changes.

5. Terms of Payment

You can use the following payment methods to purchase our products:

bill

We supply private individuals residing in Switzerland as well as companies and organizations with an entry in the Swiss commercial register with a positive credit rating on account. Vouchers cannot be obtained against invoice. However, König Sound and Vision reserves the right to refuse delivery by invoice without giving reasons. There is no possibility of discount deduction. The invoice is due for payment within 14 days. In the event of late payment, default interest of 8% per year plus a fee of CHF 15 per reminder will be charged. König Sound and Vision is also entitled in default of payment to assign the claim to a debt collection company at the expense of the customer. The assertion of further damages remains reserved.

Credit card

Payment is made by debiting your credit card. We accept VISA and MasterCard. You enter your credit card details during the ordering process through a secure connection in our online shop and we transmit your data in encrypted form directly to our payment provider. For security reasons, we do not store your credit card details. Your credit card will only be charged once the order process has been completed. We will ship your order immediately.

Cash and carry

You pay for your order when you pick it up in our shop. We accept cash payment, payment by PostCard and Maestro card and payment by credit card (Visa, MasterCard). We will notify you immediately when your order is ready for collection from us.

6. Credit Check

König Sound and Vision reserves the right to obtain credit checks on the customer and can forward customer data to third parties for this purpose. Payment experiences, in particular about undisputed claims that have not been paid after the due date, as well as any debt collection information and address data, are sent to CRIF AG in Zurich for lawful use as a credit agency. CRIF will use the data to check your identity and creditworthiness and will disclose it to authorized third parties. The payment experiences can be analyzed by CRIF on the basis of mathematical-statistical calculation methods for automated decision-making, in particular for the assessment of a person’s creditworthiness. 7. Delivery and Shipping Costs

Deliveries are generally only possible within Switzerland. Delivery is made directly from the König Sound and Vision warehouse to the delivery address specified by the customer. Information about the delivery date are not binding. Exceeding the delivery period does not entitle you to compensation. If König Sound and Vision is unable to deliver the ordered goods through no fault of its own because a supplier of König Sound and Vision does not fulfill its contractual obligations, König Sound and Vision is entitled to withdraw from the order. In this case, the customer will be informed immediately that the ordered goods are not available. If delivery to the customer is not possible because the customer cannot be found at the delivery address specified by him, although the customer was informed of the delivery time within a reasonable period of time, the customer shall bear the costs for the unsuccessful delivery.

Delivery is by parcel service or forwarding agent. The shipping costs for transport, packaging and insurance differ according to the weight of the delivered goods. The following gradations are applied:

Any transport damage found must be reported to the delivery service immediately upon receipt of the goods. In this case, please refuse acceptance and have the parcel returned by the parcel service. You must also report any shipping damage to King Sound and Vision within 7 days of receipt of the goods. We will refund any damaged items free of charge and promptly reship the ordered goods.

8. Retention of Title

The delivered goods remain the property of König Ascona SA until the invoice amount has been paid in full. The latter is entitled to have a retention of title entered in the relevant register.

9. Right of Withdrawal

You can cancel your order within 10 days in text form (e.g. letter, fax, e-mail) or by returning the goods without giving reasons. The period begins upon receipt of the goods and not before receipt of this instruction. The timely dispatch of the cancellation or the goods is sufficient to meet the cancellation deadline. In the event of an effective revocation, the mutually received services are to be returned. If you cannot return the service received in whole or in part or only in a deteriorated condition, you must compensate us for the value in this respect. This does not apply if the deterioration of the goods is exclusively due to their inspection – as you would have been able to do in a retail shop. You can also avoid an obligation to pay compensation by not using the goods as if they were your property and refraining from anything that could impair their value.

Goods that can be shipped by parcel are to be returned. You have to bear the costs of the return if the delivered goods correspond to the ordered ones. Otherwise, the return is free of charge. Goods that cannot be sent by parcel will be picked up from you. Obligations to refund payments must be fulfilled within 14 days after calculation. The purchase contract is dissolved after the goods have been returned and we will pay back payments already made within 14 days by bank transfer. Shipping costs and fees for individual payment methods will not be reimbursed unless the delivered goods do not correspond to those ordered. Please note that only sufficiently franked returns will be accepted.

The prerequisite for the revocation is that the items are unused, complete and in perfect original packaging. Articles that have been manufactured, personalized or specially ordered on behalf of the customer are excluded from return.

10. Warranty

Depending on the manufacturer, the warranty is at least two years, starting with the arrival of the goods at the customer. Upon arrival, the customer must inspect the goods immediately for defects and quality. If delivered items have obvious material or manufacturing defects, including transport damage, please report such defects immediately (within a maximum of 7 days) to us and the person who delivers the items. If there is a defect in the purchased item, the customer can request subsequent performance (remedy of the defect or replacement delivery). König Sound and Vision has the right to free repairs during the warranty period. A partial or complete exchange of the article is permissible. If defects are not remedied within a reasonable period of time, the buyer is entitled to change or reduction. In the case of complaints, the date of purchase must be proven with an invoice. The item complained about must be sent in with sufficient postage together with a copy of the invoice. The warranty does not cover normal wear and tear. The warranty expires if the customer changes the delivered goods.

11. Data Security

Our online shop is encrypted using SSL, which means that all of your offer data, your payments and your customer data are securely transmitted to us. We store your order data and treat them as strictly confidential. The relevant data is processed and used for the establishment, implementation and processing of the contracts concluded via the online shop and for the purpose of future customer support and customer care. Credit card data are not stored by us.

12. Jurisdiction and Applicable Law

In the event of legal disputes, Swiss law applies exclusively. The place of fulfillment for all contractual and legal claims is the registered office of König Ascona SA.

The place of jurisdiction is determined by the Place of Jurisdiction Act and, in the case of orders by consumers, is at the consumer’s place of residence or at the registered office of König Ascona SA. For orders that were not commissioned by private individuals, the exclusive place of jurisdiction is the registered office of König Ascona SA.

13. Final Provisions

Should individual provisions of the contract with the customer, including these General Terms and Conditions, be wholly or partially invalid, or should the agreements contain a loophole, this shall not affect the validity of the remaining provisions. The wholly or partially ineffective provision will be replaced by an effective provision whose economic success comes closest to that of the ineffective provision.

König Ascona SA expressly reserves the right to adapt these General Terms and Conditions to the circumstances at any time and to apply them immediately.
